By visiting our website and/or buying something from us, you agree to be bound by the following terms and conditions including those set out below and any additional terms and conditions and policies we make reference to, or link to.

These terms apply to all users of the website, please read them carefully before using our online sales functions.

  1. Our products and services:
    1.1) Our Products are sold subject to their product descriptions. We take care that these are as accurate as possible but they may occasionally contain inaccuracies, omissions or typographical errors.
    1.2) In all instances, any photographic representations of artworks will be affected by screen colour settings, lighting conditions and the inherent limitations of capturing and presenting a physical, visual work through a digitally presented medium. We do our best to accurately represent any work, but if you are at all unsure, please contact us for further information before committing to a purchase.
    1.3) Further information, detail and descriptions on the nature of a particular product’s medium can be found be in our FAQ section, and these descriptions form part of the product’s detailed description.
    1.3) We reserve the right to change or update information; withdraw the product from sale or cancel orders.

  2. Returns and Refunds Policy

    2.1 Artworks
    2.1.1) Conclave Brighton acts as an agent for its artists, and as such, we sell artworks on their behalf. Our primary business is conducted face-to-face through the physical gallery located at 9 Queens Road, Brighton, BN1 3WA, where all products are available to view and inspect.
    2.1.2) In addition to in-person sales, we offer an online sales function for selected artworks for which we provide online functionality to facilitate safe and secure sale and payment processing.
    2.1.3) Any sales made online are considered bespoke and made-to-order and all sales are final and non-refundable as we are acting as an agent on behalf of the artist.
    2.1.4) Prior discussion and the option to inspect in person at the physical gallery space is available for anyone who is not willing to accept the terms and conditions of these online sales. Any specific requirements or assumptions made about a product (not detailed in the product listing) should be directed to us in advance of making an online purchase.
    2.1.5) Product listing descriptions, photographs (along with any further detailed explanatory notes within our FAQ section) will provide the best overall description of any artwork within the constraints and limitations of a digital platform. Photographs (in particular) can never be 100% accurate where the differences in rendering colour and brightness on a digital screen are fundamentally different to those of pigments and colours experienced by the human eye, in person. By ordering a product online, you accept these limitations as part of the conditions of sale.
    2.1.6) UK P&P (postage and packing) fees quoted within a product listing are based on our standard P&P service. These fees will be added to your order at checkout, where alternative P&P services can be selected if required (see our FAQ section for more information on these services). Should the (system-calculated) total P&P fee at checkout appear unreasonable, please contact us via email (gallery@conclave-brighton.co.uk) in advance of completing the online order, as we may be able to reduce this via a manual intervention in the online shop system.
    2.1.7) The P&P (postage and packing) fee for international (non-UK) orders will be quoted in advance, and is tailored to each order to ensure the most suitable postal/courier service can be provided for the occasion, and is therefore stated within the order’s product description (or the specific P&P online product within the online shop, if we ask you to use one.)
    2.1.8) For all non-UK orders, we will do our best to facilitate your act of importing the purchase into the final destination country, but we do not act as a “full-service”, “end-to-end” exporter: you are responsible for any import duties, taxes or other fees that may be incurred as a result of the transfer of goods across international borders. All international sales are final, and orders refused entry and/or destroyed at the destination country’s Customs Service will not be refunded unless this is proved to be due to an error in our customs declaration paperwork. It is the buyer’s responsibility (as importer) to ensure that the goods being ordered are not subject to local customs restrictions at the destination country.
    2.1.9) Where a free delivery option is selected at checkout, but the order does not qualify for free P&P (either by way of total order value, or the location of the delivery address) we will make contact with the customer to advise of additional fees due, and provide an online function for secure payment of these additional fees. Products ordered will not be despatched until any additional P&P fees are paid in full.
    2.1.10) We reserve the right to cancel an order (and refund in full) where the online system-calculated P&P fee on a total order does not cover our actual P&P costs. This is rare, and we will endeavour to contact the customer to explain the situation and offer alternatives prior to cancelling an order.

    2.2. Services, e-Tickets and Digital Gift Vouchers
    2.2.1) All services, event tickets and gift vouchers sold via the online store on this website contain the terms and conditions specific to each sale and order within each individual “product” listing, or as linked to within that listing.
    2.2.2) In the case of requiring a cancellation (and refund) of a service, e-ticket or digital gift voucher bought via this website (and where the conditions are met to enable and permit the cancellation, as noted in the individual product listing’s terms and conditions) the buyer should contact us at gallery@conclave-brighton.co.uk in the first instance to request and arrange cancellation of the purchase.

  3. Refusal and/or cancellations of orders/transactions:
    3.1) In some circumstances, we may need to refuse or cancel an order for a product or service, and we reserve the right to do this to anyone, for any reason, at any time.
    3.2) In the unlikely event that we need to make a change to, or cancel, an order, we will attempt to contact you via the information you have provided. In using our site, you agree to provide current, complete and accurate billing and shipping information for all purchases made at our store and that your use of, or inability to use, the service is at your sole risk.
    3.3) If we cannot complete your order we will endeavour to refund any corresponding payments made via the original payment method, failing this, we will attempt to contact you via the contact details you have provided, to advise you of the situation and provide (and agree) further options for refund of the cancelled order.

  5. Online Store Functionality:
    5.1) Our online shop functionality is hosted and provided by WooCommerce, with card payments handled through a trusted and secure payment gateway provided by Stripe. In combination, they provide us with the online e-commerce platform that allows us to sell our products and services to you.
    5.2) Your payment data is processed (and stored where legally necessary and permissible, and in compliance with their data policy) through WooCommerce and Stripe’s data storage, databases and applications. They store your data on a secure server behind a firewall and adhere to GDPR legislation.
